It is a legal requirement for all Employers to have a Default Superannuation Fund. Employers are required to open a Superfund on behalf of an Employee when the Employee does not have a Superfund or when the Employee asks the Employer to open a new fund on their behalf through the Employer's Default Fund.

The Employer Default fund details also must be included in the Superannuation Choice Form provided to all Employees at the start of their employment.

A Business is required to register as an Employer to one of the Superfunds listed in their Industry Award.
