Personal/Carers Leave is generally not paid out at termination of Employment. However, Employers should always exercise due diligence and check if a specific termination type or Employment Agreement requires payment of Personal Leave at termination of Employment. Generally, personal Leave may be paid out at termination in the following circumstances:
When an Award includes a provision to pay Personal Leave at termination, this clause often includes a set of conditions for the Personal Leave to be paid out. Common payment conditions include how the type of Employment termination, the number of years of Employment or the balance of Personal Leave at the time the employment ended.
